By my reading, that may be the loophole we need. The Court struck down the Medicaid "penalty" it levied on states for noncompliance, so it seems to me the whole thing is left up to each individual state whether to comply with the Affordable Care Act (ACA) or not. But as I've said elsewhere, this decision is so confusing that I'm really not sure.
