Gov. Rick Perry has added legislation banning "intrusive" airport security screenings among the items in the special legislative session.

Texas Rep. David Simpson sponsored a bill in the House last month that would make it a criminal offense for officials conducting traveler pat-downs to touch "the anus, sexual organ, buttocks, or breast of another person" including through clothing.

The measure died in the Senate after a threat from federal officials to close airports if it were approved.

TO THE SENATE AND HOUSE OF REPRESENTATIVES OF THE EIGHTY-SECOND TEXAS LEGISLATURE, FIRST CALLED SESSION:

WHEREAS, the people of Texas, through their state constitution, have placed the power to call the legislature into special session in the hands of the chief executive officer of the state; and

WHEREAS, the members of the Eighty-Second Texas Legislature, First Called Session, have now convened to consider items presented to them by the governor;

NOW, THEREFORE, I, RICK PERRY, Governor of the State of Texas, by the authority vested in me by Article IV, Section 8, and Article III, Section 40, of the Texas Constitution, do hereby present the following subject matter to the Eighty-Second Texas Legislature, First Called Session, for consideration:

Legislation relating to prosecution and punishment for the offense of official oppression of persons seeking access to public buildings and transportation.


IN TESTIMONY WHEREOF, I have signed my name officially and caused the Seal of the State to be affixed hereto at Austin, this 20th day of June, 2011.

If there's any doubt that Rick Perry plans to run for President, this should dispel them. The TSA is so universally disliked that he just can't lose by doing this.

I think every body should pass this bill....
I heard a little old lady in the suppermarket
say, they need to treat the TSA like the UN.
If they start haveing road blocks.
I told the ladie, maybe they will give them Blue Helmets. She said It makes her want to buy one of them there Black Rifles like the Soldiers carrie.

I think TSA has got every body pissed.

Today the Texas House passed a revised version of the bill, which applies to a public servant who, "while acting under color of the person's office or employment, without probable cause to believe the other person committed an offense, performs a search without effective consent for the purpose of granting access to a publicly accessible building or form of transportation" and "intentionally, knowingly or recklessly touches the anus, sexual organ, buttocks, or breast of the other person, including touching through the clothing."

This afternoon the Texas House of Representatives took the next step toward restricting government officials from groping innocent citizens as a condition of travel without cause, passing HB 41 on second reading by voice vote. Three amendments were offered and passed by the bill’s author Representative David Simpson (R-Longview), Representative Allen Fletcher (R-Houston), and Representative Pete Gallego (D-Alpine).

“We’ve been working with the Attorney General’s office from the very beginning to ensure that the bill will accomplish our goal of stopping the humiliation of travelers while also maintaining language that will withstand judicial scrutiny,” said Simpson.

Simpson continued, “Texas citizens deserve to be protected under the 4th Amendment to the US Constitution and Article 1 Section 9 of the Texas Constitution. Today the Texas House took a positive step toward protecting those rights.”

The bill died in the Texas legislature again , on the last day of the special session. But some lawmakers are vowing to bring it up again in the future.

The bill, which prompted federal officials to threaten to ground flights in the state, failed during the Legislature's regular session in May, but was revived when Gov. Rick Perry ordered that it go on the special session's agenda.

The bill passed in the Senate, but in the House a four-fifths vote was required to suspend constitutional rules and bring the bill to a vote. The procedural vote failed 96 to 26....

Ron Paul has introduced the American Traveler Dignity Act.

Republican presidential candidate Rep. Ron Paul (R-Tex.) has once more called for the privatization of airport security amidst the “appalling treatment” travelers receive at airports, in the latest post on the congressman’s “Texas Straight Talk” blog.

“The press reports are horrifying,” Paul wrote. “Ninety-five-year-old women humiliated, children molested, disabled people abused. Men and women subjected to unwarranted groping and touching of their most private areas, and involuntary radiation exposure.”

Paul mentioned a piece of legislation he will introduce this week — The American Traveler Dignity Act - that will address his concerns about airport security and personal privacy. The act, in essence, would hold Transportaion Safety Administration (TSA) employees to the same standards as average citizens in regards to physical contact, making images of another person or causing “physical harm” to another person through the use of radiation-emitting machines.

The TSA has been on the receiving end of much criticism after a string of recent incidents including a Nigerian man who slipped through the agency's security all together with over 10 boarding passes belonging to various individuals last week.

Paul’s critique of the TSA and the federalization of airport security dates back to the agency’s creation shortly after 9/11.

“Congress should be privatizing rather than nationalizing airport security," Paul wrote in a 2001 article. "The free market can and does produce excellent security in many industries. Many security-intensive industries do an outstanding job of maintaining safety without depending on federal agencies."
