Every president since FDR has declared some kind of emergency. They do it all the time. Securing our border to prevent invasion is one prerogative that the president most definitely has the authority to exercise as CIC. Like I keep saying, Trump said he does NOT want to declare a state of emergency, but will do so if Congress refuses to act or negotiate. Even Joel Skouson said he wasn't in favor of emergency powers. But in this case, Trump should tell Congress to screw itself and bypass them.
